Terms of Use

Defined terms. "Platform" means SafetyZone, operated by Powers Solutions USA LLC. "Operator" means the restaurant, hotel, venue, school, or other business publishing menu information through the Platform. "Guest" means a diner who views a published menu.
1. The Platform is an information tool.
SafetyZone displays menu, allergen, and dietary information entered and controlled by the Operator. It is not a food-safety system, not a medical device, and does not test, inspect, prepare, handle, or verify food. It does not detect allergens and does not warrant that any item is safe for any Guest.
2. Operator responsibility for accuracy.
The Operator is solely responsible for the accuracy, completeness, and currency of all information it enters or approves — dishes, ingredients, allergen designations, dietary labels, and shared-equipment/cross-contact disclosures. The Operator represents such information is true and current when published.
3. Duty to update.
The Operator will promptly update the Platform when any recipe, ingredient, supplier, preparation method, or availability changes, or when it learns any published information is inaccurate. The Operator acknowledges out-of-date information may cause Guest reliance.
4. Staff confirmation.
The Operator will not present the Platform as a substitute for a Guest speaking with staff. Final responsibility for safely serving a Guest with allergies rests with the Operator and its staff.
5. Cross-contact.
Cross-contact can occur in any kitchen. The Platform cannot detect or prevent it. The Operator is responsible for accurately disclosing its shared-equipment and cross-contact practices.
6. No warranty.
The Platform is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. The Platform does not warrant that any menu or allergen information is accurate or that any food is safe for any Guest.
7. Limitation of liability.
To the maximum extent permitted by law, the Platform is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any personal injury, illness, allergic reaction, or death arising from food prepared, served, or described by the Operator. The Platform's total aggregate liability is limited to the fees paid by the Operator in the preceding 12 months.
8. Indemnification.
The Operator will defend, indemnify, and hold harmless the Platform and its officers, employees, and agents from any claim, loss, liability, or expense (including reasonable attorneys' fees) arising from (a) the accuracy or currency of information the Operator published, (b) food the Operator prepared, served, or handled, or (c) the Operator's breach of these Terms.
9. Independent parties.
The Operator is an independent business. Nothing in these Terms creates a partnership, joint venture, agency, or guarantee relationship. The Platform is not responsible for the Operator's acts, omissions, staffing, or food handling.
10. Per-location responsibility.
For multi-location Operators, each location is separately responsible for the information it publishes and the food it serves, and attests separately.
11. Limits of these Terms.
Nothing in these Terms attempts to disclaim liability for a party's own gross negligence, recklessness, or willful misconduct, or any liability that cannot lawfully be waived. If any provision is unenforceable, the rest remains in effect.
12. Governing law and disputes.
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws rules. Venue and any arbitration provisions will be as specified by Powers Solutions USA LLC in a subsequent update to these Terms upon counsel review.
13. Changes.
The Platform may update these Terms. Continued use after an update, or a renewed attestation, constitutes acceptance.
14. Acceptance.
By accepting at onboarding, the Operator confirms it has read, understood, and agreed, and that the person accepting is authorized to bind the Operator.
